Hosts (“you”, “your”) may choose to receive installation of an electronic device (“Rentalogue Go Device ”) in their vehicle and/or grant Rentalogue access to in-vehicle software to enable additional features of the Services (collectively, the “Rentalogue Go Program”). Participating in the Rentalogue Go Program is subject to these terms and conditions (“Rentalogue Go Terms”). The Rentalogue Go Terms apply in addition to Rentalogue Terms of Service and user policies (“Rentalogue Terms ”).
All capitalized terms shall have the meaning set forth in the Rentalogue Terms, unless otherwise defined in these Rentalogue Go Terms. If you agree to these Rentalogue Go Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Rentalogue Go Terms and, in such event, “you” and “your” will refer and apply to that company or other legal entity. If you do not agree with any part of these Rentalogue Go Terms, you should not participate in the Rentalogue Go Program.
Modification
Rentalogue reserves the right, at our sole discretion, to modify our Services, the Rentalogue Go Program, or to modify these Rentalogue Go Terms at any time. If we modify these Rentalogue Go Terms, we will post the modification on our Services. We will also update the “Last Revised” date at the top of these Rentalogue Go Terms. By continuing to access or use our Services and the Rentalogue Go Program after we have posted a modification or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Rentalogue Go Terms. If the modified Rentalogue Go Terms are not acceptable to you, your sole recourse is to stop using and accessing the Services within 15 days, in which case the previous effective version of the Rentalogue Go Terms will apply to you, unless you have used the Services during the intervening 15 day period, in which case the new Rentalogue Go Terms will apply to you.
Device Ownership; Limitations
Rentalogue retains all right, title and interest in and to the Rentalogue Go Device and associated firmware. You are responsible for the loss of or any damage to the Rentalogue Go Device. You shall have no right to sell, give away, transfer, pledge, alter or tamper with the Rentalogue Go Device at any time. You agree that you will not reverse engineer, disassemble, decompile, alter, duplicate or make copies of the Rentalogue Go Device firmware or otherwise attempt to derive the source code of the firmware. You may not resell the Rentalogue Go Device.
Device Installation
In some cases, in order to take advantage of the Rentalogue Go Program for a vehicle, a Rentalogue Go Device must be installed in the vehicle and remain installed for as long as you wish to participate in the Rentalogue Go Program. Rentalogue Go Devices must be installed by Rentalogue, or a third-party installation vendor authorized by Rentalogue (“Authorized Vendor”), to use the Rentalogue Go Program. By scheduling installation of a Rentalogue Go Device in a vehicle, you represent and warrant that you have the authorization and consent of the registered vehicle owner to install the Rentalogue Go Device and allow us to collect details and information from the Rentalogue Go Device and retain and use such data, details and information in accordance with these Rentalogue Go Terms and our Privacy Policy. If the vehicle scheduled for installation of a Rentalogue Go Device has any other third-party devices installed, you must arrange for the de-installation and removal of such devices from the vehicle prior to installation of the Rentalogue Go Device. Rentalogue is not responsible or liable for any losses associated with the removal of third-party devices to enable installation of the Rentalogue Go Device or any customer service issues which may arise with such third-party.
Device Operation
The Rentalogue Go Device and Rentalogue Go Program are only enabled on booking time via https link generated, wireless network, including but not limited to cellular and Bluetooth connections. Rentalogue does not assume any responsibility for reception quality. You understand that the provision of the Rentalogue Go Program is subject to reception of the technically necessary signals. If you cannot receive such signals (e.g., due to a change of the network service or long-term technical restrictions or difficulties), you will be unable to use the Rentalogue Go Program to the full extent. The Rentalogue Go Device draws power from the vehicle’s battery. You acknowledge and agree that the performance of the Rentalogue Go Device is dependent on your vehicle’s battery health. If your vehicle is old, has a weak battery or may not be driven for long periods of time, a Rentalogue Go Device may not be right for you.
Device Removal or De-Installation
If the Rentalogue Go Device is removed from your vehicle at any time, you must inform us immediately. If a Rentalogue Go Device is removed from your vehicle, re-wired or uninstalled by anyone except Rentalogue or an Authorized Vendor, re-installation of the Rentalogue Go Device in the same or another vehicle will be subject to additional fees. If ownership of a vehicle is transferred before a Rentalogue Go Device is removed, you must inform us immediately to disable the Rentalogue Go Device and Rentalogue Go Program and reimburse us for the Rentalogue Go Device, up to ₹10,000. If you fail to inform Rentalogue regarding a transfer of ownership of a vehicle with a Rentalogue Go Device, you will indemnify and hold harmless Rentalogue, its affiliates, subsidiaries, agents, licensors and each of their employees, contractors, agens, directors and officers from and against any and all claims, liabilities, damages, losses and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with such transfer, including with respect to damage to the applicable vehicle or loss of data.
Rentalogue Go Program
Subject to these Rentalogue Go Terms, we grant you a limited right and license to use and participate in the Rentalogue Go Program in connection with the Services. You may not use the Services or the Rentalogue Go Program for any unlawful purposes or in connection with the placement of your vehicle on any other car sharing platform.
Fees and Costs
Unless subject to a special promotion or other discount, Rentalogue will didn't charge you a one-time installation fee, but charge a monthly subscription fee for use of the Rentalogue Go Device and Rentalogue Go Program. Rentalogue will collect these and all fees associated with the Rentalogue Go Program from your available earnings when incurred. We will collect these fees, regardless of whether your vehicle is listed or enabled on the Services. If your vehicle is disabled from the Services for any reason, including for an open safety recall, the fees will continue to be due. If a Rentalogue Go Device is removed from a vehicle and/or you no longer wish to access or participate in the Rentalogue Go Program, you must inform us immediately; we will continue to charge the fees until we are informed of your withdrawal from the Rentalogue Go Program. If you fail to return any Rentalogue Go Device removed from your vehicle, Rentalogue will have the right to collect from your next earnings disbursement an amount up to ₹1000
Vehicle Data
As described in our Privacy Policy, we may collect certain data as part of the Rentalogue Go Program about the vehicle, trips and other information (“Trip Data”). This Trip Data may be useful in resolving certain claims and disputes, including determining the cause of an automobile accident. In connection with your use of the Services and participation in the Rentalogue Go Program, you may have access to certain Trip Data, including information about your vehicle and its location. You may not use any Trip Data for any unlawful purpose or otherwise in connection with any third-party. You expressly agree to indemnify and hold Rentalogue harmless from any and all claims or damages that result from your use of all or part of the Trip Data.
Compliance with Terms and Laws
You will always use the Rentalogue Go Device and Rentalogue Go Program in compliance with these Rentalogue Go Terms, the Rentalogue Terms, applicable laws and regulations, and any other policies and standards provide to you by Rentalogue.
Disclaimer of Warranties
Rentalogue provides you the Rentalogue Go Device as-is and as-available, and makes no warranty, either expressed or implied regarding the Rentalogue Go Device provided to you. All such warranties, including, without limitation, the implied warranties of merchantability and fitness for a particular purpose, are expressly excluded. Rentalogue is not responsible for any special, incidental or consequential damages relating to the Rentalogue Go Device Rentalogue provides to you. In addition, Rentalogue, its subsidiaries, affiliates and licensors do not warrant that the Rentalogue Go Device is reliable, will be available at any particular time or location, uninterrupted or secure or the Rentalogue Go Program is accurate, reliable, correct, available at a particular time or location, uninterrupted or secure.
Indemnification
To the extent permitted by applicable law, you agree to release, indemnify and hold Rentalogue and its subsidiaries, officers, directors, employees, agents and licensors, harmless from and against any claims, liabilities, damages, losses and expenses, including, without limitation, reasonable legal fees, arising out of or in any way connected with your access to or use of the Rentalogue Go Device or us of or participation in the Rentalogue Go Program; or your violation of these Rentalogue Go Terms.
Order of Precedence
In the event of a conflict between the Rentalogue Go Terms or the Rentalogue Terms, the Rentalogue Go Terms will control with respect to use of the Rentalogue Go Device and/or use of, or participation in, the Rentalogue Go Program.
